E-Sign Consent
CONSENT TO USE ELECTRONIC RECORDS AND SIGNATURES
Third Coast Bank (“TCB”) is required by law to give you certain information “in writing” – which means you are entitled to receive it on paper. However, with your prior consent, TCB may instead provide this information electronically (“E-Sign Consent”). As such, please review and consent to the terms outlined below.
Definitions
- “You” and “your” means the person giving the consent and also each additional account owner, authorized signer, authorized representative, agent and/or any user identified on the TCB account that you apply for, use, and/or access.
- “Communications” means each disclosure, notice, agreement, fee schedule, statement, record, document and other information we provide to you, or that you sign, submit or agree to at TCB’s request.
Terms
1. Your consent to use electronic records and signatures and receive Communications electronically
In TCB’s sole discretion, the Communications provided to you, or that you sign or agree to, may be in an electronic format, unless otherwise prohibited by applicable law (“Electronic Records”). TCB may also use electronic signatures and obtain them from you in connection with account transactions. Electronic Records may be delivered to you in a variety of ways, including via email or text, in accordance with your account agreement, your consent, and/or applicable law (“Method of Delivery”). There may be some Communications that TCB is required by law to deliver by mail. So long as required by law, TCB will continue to deliver those Communications by mail. However, if the law changes and permits such Communications to be delivered electronically, the E-Sign consent will automatically cover those Communications as well. Tax statements will continue to be provided by mail unless you separately elect to receive them electronically. Your consent remains in effect until you give us notice that you are withdrawing it.
2. Option to receive paper copies
If you are receiving Electronic Records, and you want a paper copy, you may contact servicecenter@thirdcoast.bank and request a paper version. You may be required to pay a fee for the paper copy unless charging a fee is prohibited by applicable law. Please refer to the applicable agreement for any fee that may apply for paper copies.
3. Privacy Notice
You agree that TCB may satisfy its obligation to provide you with an annual copy of its Privacy Policy by providing it to you electronically in accordance with your elected Method of Delivery.
4. Withdrawal of consent
You have the right to withdraw your consent at any time. Please be aware, however, that withdrawal of consent may impact services or functionality available to you, including but not limited to, termination of your access to electronic services, such as online banking. Your withdrawal of consent will become effective after TCB has had reasonable opportunity to act upon it or as otherwise required by applicable law. If you are receiving electronic statements, the termination will cause paper statements to be mailed to you via the U.S. Postal Service. Additional fees may apply; please refer to your agreement. To withdraw your consent, you may contact TCB at servicecenter@thirdcoast.bank. In addition, to the extent Communications are sent via text message to a mobile device, you may withdraw consent by responding to the Communication with “STOP”, or by following the instructions in the Communication.
5. Notify TCB of any changes to your contact information
You must promptly notify TCB of any change to your contact information, including your email or phone number. You can contact the service center by emailing servicecenter@thirdcoast.bank or by calling 833.844.7708.
6. System requirements
In order to receive Electronic Records via email, you must have access to:
- A current version of an internet browser;
- A connection to the internet;
- A current version of a program that accurately reads and displays PDF files;
- A computer and an operating system capable of supporting all of the above; and
- An active email address.
In some cases, you may also need a device that can support a particular software application, such as an application intended for a particular mobile device.
By providing your consent, you are also confirming that you have the system requirements described above, and that you are able to receive and review Electronic Records. You are also confirming that you are authorized to, and do, consent on behalf of all other account owners, authorized signers, authorized representatives, agents and users.
